§ 10.12.120. Overnight parking on the streets

  • A. Commercial Vehicles.

    1. No vehicle exceeding the following standards shall be parked overnight in any residential zone:

    a. Vehicles containing signs/markings totaling more than eighteen inches (18″) by twenty-four inches (24″) on any side of the vehicle;

    b. Any vehicle which is longer than eighteen feet (18'), six inches from bumper to bumper or is more than seven feet six inches from the ground to the upper most roof, equipment rack, warning beacon or similar attachment;

    c. Any vehicle containing equipment, contractor tools, supplies and/or materials, exposed to public view with the exception of not more than one ladder or equivalent amount of pipe mounted on a roof or bed rack.

    2. Any and all vehicles exceeding the above standards must be parked in a garage or behind the rear building line.

    3. No more than one vehicle with commercial license plates may be parked in any residential zone unless the vehicles are housed in a garage.

    4. Excluded from the above prohibitions are vehicles of agencies providing emergency service while actually engaged in emergency or service calls.

    5. This section may be read in conjunction with Section 18.72.100 and may be enforced either under the zoning ordinance or under the general police regulations.

    6. This subsection shall be enforced by any appropriate official including the police department and zoning officer.

    B. Abandoned Vehicles.

    1. No vehicle shall be parked upon the street or any section of the street, roadway, alleyway or right-of-way unless that vehicle has proper license plates, valid registration, valid inspection sticker and valid insurance.

    2. No vehicle shall be parked upon the public street or any section of street, roadway, alleyway or right-of-way without the vehicle being moved from that location for a period of at least one hour for more than five consecutive days.

    3. Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any peace officer may provide for the removal of such vehicle upon one day's notice to the owner thereof. In the event the owner cannot be located, no such notice shall be required. The owner shall pay the reasonable costs of removal and storage which may result from such removal, before regaining possession of the vehicle.

    C. Violation—Penalty. Any person who shall be guilty of a violation of this section shall be subject to a fine of thirty-five dollars ($35.00) for each violation.
